TERMS AND CONDITIONS - Advertisers/Listing Companies

This Agreement describes the terms and conditions applicable to your ( "Advertiser") use of our services. Findacontractor.ca is a service of Envisionet Web Services and is herein referred to as ("Findacontractor.ca").

General Disclaimer

Findacontractor.ca listing services are available to bona fide firms and individuals. Findacontractor.ca is not responsible for any goods and services offered through the web page Listings or advertisements.

The Advertiser agrees to use the Findacontractor.ca web pages in an ethical manner to promote his/her services. If any information provided by the Advertiser is untrue, misleading, inaccurate or in any other way offensive, Findacontractor.ca reserves the right to refuse any and all future use of the service by the Advertiser. Findacontractor.ca reserves the right to remove any Advertiser at any time at it's sole discretion. The Advertiser agrees that he/she is solely responsible for all content contained in his/her advertisement on Findacontractor.ca. Findacontractor.ca reserves the right to inform the Advertiser by mail, phone, fax or e-mail of additional products and services offered by Findacontractor.ca

Indemnity

Findacontractor.ca is not responsible for any loss of data or business resulting from system or network breakdown or outage or any other reason. The Advertiser agrees to indemnify and hold harmless Findacontractor.ca and it's officers, employees and affiliated entities for any loss, claim, liability and/or monetary damages (including reasonable legal fees) arising from the use of the Findacontractor.ca advertising service.

Changes to the Service or Terms

Findacontractor.ca reserves the rightTo modify, change or discontinue the service with or without notice to the Advertiser.

Termination or Cancellation of the Service

By Advertiser: The Advertiser may discontinue use of the service for any or no reason. Termination within 45 days of an Advertiser registering for the service will result in a full refund of any fees that may have been paid to Findacontractor.ca by the Advertiser to display text and/or images throughout the service. Termination after the 45 day period will result in a refund, on a pro rata basis, of any fees that may have been paid to Findacontractor.ca by the Advertiser to display text and/or images throughout the service.

By Findacontractor.ca: Findacontractor.ca reserves the right to deny or terminate service to anyone for any or no reason provided that Findacontractor.ca refunds on a pro rata basis any fees that may have been paid to Findacontractor.ca by the Advertiser to display text and/or images throughout the service.

Use of Submitted Information

If you submit any information or materials to Findacontractor.ca , including, but not limited to, project information, your experiences, and expert content, via the Internet or otherwise, you authorize Findacontractor.ca to use such information at no charge and at Findacontractor.ca's sole discretion.

Governing Laws

The laws of Canada and the Province of British Columbia shall be the choice of law for any issue arising out of these terms and conditions.

By using Findacontractor.ca, you acknowledge that Findacontractor.ca is not acting as, your general contractor, agent, or advisor. Therefore, it is your sole responsibility to select a Service Provider and to negotiate the terms for any work to be performed by your Service Provider.

Findacontractor.ca does not:
i. endorse any specific Service Provider
ii. provide advice on which service provider to select, or
iii. warrant any of the work a service provider may provide to User.

Findacontractor.ca does not guarantee or warrant the qualifications of any service provider listed with Findacontractor.ca.

Changes to the Service or Terms

Findacontractor.ca may at its sole discretion and without notice, add, or remove certain features of Findacontractor.ca or change the terms of this Agreement. Such changes shall be posted on Findacontractor.ca website.

Disclaimer of All Warranties / Waiver of Rights

You acknowledge and agree that Findacontractor.ca is a free service to the User and that such services are provided an "AS IS" basis. Findacontractor.ca makes no representation or warranty of any kind, express or implied, as to the quality of service providers or the exactness of any information provided to the User. As such the User expressly agrees that any use of information provided by Findacontractor.ca is for the User's personal use and that such information will be acted on by the Users, at the Users sole risk. As such the User waives the right to file suit against Findacontractor.ca or agents, officers, and employees thereof.

Limitations of Liability and Release

Findacontractor.ca will not be liable for damages of any nature relating to or arising from your use of the Findacontractor.ca website. You agree not to hold Findacontractor.ca responsible for any damages or other liabilities arising from work performed by any service provider. Findacontractor.ca is not, cannot and will not be involved in your dealings with Service Providers or control whether or not Service Providers will complete any work as agreed. In the event that you have a dispute with one or more Service Providers, you release Findacontractor.ca (and our agents and employees) from any and all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Indemnity

You agree to indemnify and hold Findacontractor.ca, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of any matter under this agreement or otherwise.
